These Terms of Service ("Terms") govern your access to and use of the website customsoulmade.com (the "Site") and any product or service ordered through it (the "Service") from CSM Studio, a Studio operating the brand CSM Studio.

By placing an order or using the Site you accept these Terms in full. If you do not agree, do not use the Service.

2. What we sell

The Service offers custom digital keepsakes created from information you provide:

• The Personalized Gift Song — €29 per order. A 3–4 minute original song written from your story, with real vocals + full lyrics, delivered as an MP3 + lyrics PDF on a private delivery page.
• Custom song commissions — priced case-by-case (mini-albums, wedding processionals, event playlists, brand or corporate songs). Submit a brief at /custom-gifts; we reply within 48 hours.

All prices are shown at checkout in your local currency where available. Prices include applicable taxes where we are legally required to collect them.

3. Placing an order

You place an order by completing the checkout and intake form on the Site, providing accurate details about the recipient, occasion and story, and submitting payment. An order is deemed accepted by us when payment is confirmed and you receive an order confirmation email. Until then, we may refuse or cancel an order for any lawful reason.

4. Payment

We accept payment through Whop Checkout, which supports credit and debit cards, PayPal, Apple Pay, Google Pay, iDEAL and other local methods. You warrant that any payment instrument you use is yours and that you have the authority to use it. All charges are billed by CSM Studio and will appear on your statement under that name or CUSTOMSOULMADE.

5. Delivery

Personalized Gift Songs are delivered within 24 hours of a completed order. Custom commissions are delivered on a timeline agreed in the brief. Delivery is by email to the address you provided, with a private download link that remains valid for at least 12 months.

If we cannot deliver within these windows for any reason attributable to us, you may request a full refund under our Refund Policy.

6. Content you provide

You grant CSM Studio a non-exclusive, worldwide, royalty-free licence to use the story details, names, likenesses, reference photos and other information you submit solely to create and deliver your order. You warrant that:

• You either own the content you submit or have the rights and consents necessary to submit it, including the consent of any adult depicted in a reference photo;
• Any reference photo depicting a minor is of a child in your immediate family (or a child you have parental authority for) and is submitted with the other parent’s consent where applicable;
• Your submissions comply with our Acceptable Use & Content Policy.

We may refuse, edit or remove any submission that violates these Terms or the Content Policy.

7. Ownership of the delivered work

Upon full payment, you receive a perpetual, worldwide, personal-use licence to enjoy, download, store and share the finished work with friends and family in private contexts (weddings, memorials, birthdays, anniversaries, social posts from your personal accounts). You may not: resell, sublicense, or commercially exploit the work; use it in advertising for a third-party business; train an AI model on it; or claim it as your original composition.

CSM Studio retains ownership of the underlying craft, workflows, prompts and any generic style assets. Third-party components (music generation via sunoapi.org / Suno, imagery via Google Gemini and fal.ai) are used under their respective terms and any restrictions imposed by those providers pass through to you.

8. Refunds

Because every order is personally made, refund rules are specific. Please read our Refund Policy — it forms part of these Terms.

9. Digital delivery & EU cooling-off waiver

Under EU Directive 2011/83/EU Art. 16(m), the standard 14-day right of withdrawal does not apply to personalised digital content that begins production before the withdrawal period ends. By placing an order, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once we begin work.

10. Prohibited uses

You must not use the Service to create content that is illegal, harmful, deceptive, sexually explicit, discriminatory, or that infringes on the rights of others. See our Content Policy for the detailed list. Violations may result in immediate cancellation with no refund and reporting to authorities where legally required.

11. Warranties and disclaimers

We warrant that we will provide the Service with reasonable care and skill. To the maximum extent permitted by law, all other warranties (express or implied) are disclaimed. The Service is provided "as is". We do not guarantee that generative components will produce a specific artistic outcome; you receive our best professional effort, subject to the revision policy in Section 8.

12. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to your use of the Service is limited to the amount you paid CSM Studio in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars (US $100), whichever is greater. We are not liable for indirect, incidental, special, consequential or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable mandatory consumer-protection law.

13. Indemnity

You will indemnify and hold harmless CSM Studio, its officers, employees and agents from any claim, loss or expense arising out of (a) your breach of these Terms, (b) content you submit that infringes a third party’s rights, or (c) misuse of the delivered work.

14. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts sitting in Natrona County, Wyoming, USA — except that you may bring an action in your country of residence where required by mandatory consumer-protection law.

15. Dispute resolution

Before initiating any formal proceeding, you agree to attempt to resolve any dispute informally by contacting contact@customsoulmade.com. We will use reasonable efforts to resolve the matter within 30 days. EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to these Terms

We may amend these Terms from time to time. The current version is always available on this page with an "Effective from" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
